Action commenced by plaintiff Thomas P. Maroney, as receiver of George H. Weaver, against defendant Allstate Insurance Company
for recovery of the sum of $36,185.72 as damages sustained by said Weaver as the result of the alleged bad faith of the defendant
in failing to protect Weaver's rights and interests under the terms of a liability insurance policy issued to him by defendant.
Defendant's motion for summary judgment was granted. Plaintiff appeals from the judgment and from a subsequent order denying
plaintiff's motion for review and confirming the original order and judgment. On August 16, 1950 George H. Weaver, operating his automobile on North 24th place in the city of Milwaukee, struck and severely
injured one Harry Marschke, a minor, who was riding a bicycle on said street. The insured notified Allstate of the accident
and defendant made an investigation. Coverage under the policy was limited to $10,000 for each person.
